Ebben az esteben az \u00e1llam a piaci \u00e9rt\u00e9ken \u00e1llap\u00edtja meg az egykori ingatlan\u00e9rt j\u00e1r\u00f3 k\u00e1rp\u00f3tl\u00e1s \u00e9rt\u00e9k\u00e9t, amelyet azonban nem p\u00e9nzben, hanem \u00fagynevezett \u201c\u00e1rver\u00e9si pontok &#8211; kompenz\u00e1ci\u00f3s pontok\u201d form\u00e1j\u00e1ban fizet majd ki.<br \/>\n&#8211; Ezeket az \u00e1rver\u00e9si pontokat a k\u00e1rp\u00f3tolt m\u00e1s, az \u00e1llam \u00e1ltal \u00e1ruba bocs\u00e1tott ingatlanok megv\u00e1s\u00e1rl\u00e1s\u00e1ra haszn\u00e1lhatja fel, vagy megv\u00e1rhatja, am\u00edg azokat az \u00e1llam visszav\u00e1s\u00e1rolja.<br \/>\n&#8211; Azokban az esetekben amikor a Nemzeti Ingatlankompenz\u00e1ci\u00f3s Bizotts\u00e1g iratokat k\u00e9rt be a m\u00e1r beny\u00fajtott iratok p\u00f3tl\u00e1s\u00e1ra, \u00e9s azokat az \u00e9rdekeltek el is k\u00fcldt\u00e9k \u00e9s nem kaptak v\u00e1laszt, jogukban \u00e1ll pert inditani.<br \/>\n&#8211; A t\u00f6rv\u00e9nyes keret erre a 165\/2013-es \u00e9s 103\/2016-as t\u00f6rv\u00e9ny.<br \/>\n&#8211; Ez nagy s\u00fallyal j\u00e1r\u00f3 l\u00e9p\u00e9st jelent, hiszen 2O13 \u00f3ta el\u0151sz\u00f6r lehet bir\u00f3s\u00e1gi \u00faton s\u00fcrgetni az elj\u00e1r\u00e1st, eredm\u00e9nyt \u00e9rni el.<br \/>\n&#8211; Csak olyan esetekben lehet pert ind\u00edtani, amikor m\u00e1r van egy \u00f6nkorm\u00e1nyzati rendelet, amelyben elrendelik, hogy az ingatlant nem lehet term\u00e9szetben visszszolg\u00e1ltatni, \u00e9s k\u00e1rt\u00e9rit\u00e9si javaslatot hoznak.<br \/>\n&#8211; A perrel tulajdonk\u00e9ppen azt k\u00e9rj\u00fck a bir\u00f3s\u00e1gt\u00f3l, hogy k\u00f6telezze a Nemzeti Ingatlankompenz\u00e1ci\u00f3s Bizotts\u00e1got a kompenz\u00e1ci\u00f3s hat\u00e1rozat kiad\u00e1s\u00e1ra.<br \/>\n&#8211; Ehhez sz\u00fcks\u00e9g van az ingatlanok fel\u00e9rt\u00e9kel\u00e9s\u00e9re,<br \/>\n&#8211; Nagyon fontos tudnival\u00f3, hogy az ingatlanok fel\u00e9rt\u00e9kel\u00e9se a 165-os t\u00f6rv\u00e9ny alapj\u00e1n, a 2013-as ingatlan\u00e9rt\u00e9kek szerint t\u00f6rt\u00e9nik.<br \/>\n&#8211;
