De\u0219i, \u00een aceast\u0103 privin\u021b\u0103, principiile aplicabile sunt restitutio in integrum \u0219i restituirea \u00een natur\u0103, \u00een multe cazuri aceste principii nu pot fi puse \u00een practic\u0103 fa\u021b\u0103 de fo\u0219tii proprietari.<br \/>\n\u00cen acest caz, statul stabile\u0219te valoarea compensa\u021biei pe baza valorii pie\u021bei imobiliare, dar suma nu va fi pl\u0103tit\u0103 \u00een bani, ci \u00een a\u0219a-numitele &#8222;puncte de licita\u021bie &#8211; puncte de compensare&#8221;. Partea compensat\u0103 poate folosi aceste puncte de licita\u021bie pentru a cump\u0103ra alte propriet\u0103\u021bi v\u00e2ndute de stat sau poate a\u0219tepta ca statul s\u0103 le r\u0103scumpere.<\/p>\n<p>\u00cen cazurile \u00een care Comisia\u00a0 Na\u021bional\u0103 pentru Compensarea Imobilelor\u00a0 a solicitat documente suplimentare pentru documentele deja \u00eenaintate, iar p\u0103r\u021bile interesate le-au trimis \u0219i nu au primit un r\u0103spuns, au dreptul de a ac\u021biona Comisia \u00een judecat\u0103.<\/p>\n<p>Cadrul legal este\u00a0 constituit de anumite prevederi ale Legii nr. 165\/2013, cu modific\u0103rile ulterioare.<br \/>\nAcesta este un pas foarte important deoarece, instituie excep\u021bii fa\u021b\u0103 de reglementarea veche din 2013, put\u00e2nd fi ob\u021binute desp\u0103gubiri pe calea unei ac\u021biuni \u00een justi\u021bie.<\/p>\n<p>Procesul poate fi pornit \u0219i \u00een cazul \u00een care exist\u0103 o hot\u0103r\u00e2re judec\u0103toreasc\u0103 \u00een care se precizeaz\u0103 c\u0103 proprietatea nu poate fi restituit\u0103 \u00een natur\u0103 \u0219i se propune o compensa\u021bie.<br \/>\n\u00cen cadrul procesului cerem instan\u021bei s\u0103 oblige Comisia s\u0103 emit\u0103 decizia de compensare, iar pentru aceasta este necesar\u0103 evaluarea propriet\u0103\u021bilor pentru care s-a cerut desp\u0103gubirea.<br \/>\nEste foarte important de \u0219tiut c\u0103 evaluarea propriet\u0103\u021bilor se face conform Legii nr. 165\/2013 \u00een func\u021bie de evaluarea notarial\u0103 din 2013.<\/p>\n<p>Procesul se judec\u0103 la Bucure\u0219ti, deoarece instan\u021ba competent\u0103 este Tribunalul Bucure\u0219ti.
